A San Francisco Superior Court judge struck down two regulatory packages affecting California card rooms on Tuesday. The ruling reverses rules that were scheduled to take effect on 1 April and limits the Bureau of Gambling Control’s authority over the sector.
Regulatory Scope and Enforcement Pause
Judge Richard Darwin determined that the Bureau of Gambling Control exceeded the powers granted by the legislature and the Gambling Control Act. The decision upholds a preliminary injunction issued in May, which paused enforcement while both sides presented their cases. Darwin noted during the initial hearing and again on Tuesday that the state agency failed to demonstrate sufficient justification for the changes. A follow-up conference to address administrative matters is scheduled for 10 July.The contested regulations would have required substantial modifications to blackjack-style games, including the removal of the bust feature and the 21-point target. Dealer operations would have faced mandatory 40-minute position rotations and a requirement to offer the dealer role to every player before each hand. The state’s internal analysis projected a 50% decline in existing blackjack revenue under the new framework.
The card room sector generated approximately $5 billion in annual economic impact as of 2019, and several venues faced potential closure while host cities prepared fiscal measures such as sales tax increases.
Kyle Kirkland, president of the California Gaming Association and owner of Club One Casino in Fresno, stated that the ruling validates the industry’s position. The attorney general’s office expressed disappointment with the decision and is currently reviewing its options. The California Nations Indian Gaming Association did not provide a statement.
The state maintains two separate gaming oversight bodies, with the BGC handling prosecution and the independent commission managing routine regulation.
